1. Acceptance of Terms

By using our website, submitting a contact or estimate request form, or entering into a service agreement with Lompoc Sunrooms and Patios, you agree to these terms and conditions. If you do not agree, please do not use our website or services. We reserve the right to update these terms at any time. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.

2. Description of Services

Lompoc Sunrooms and Patios provides sunroom construction, patio enclosures, screen room installation, and related home improvement services to residential customers in Lompoc, CA and surrounding communities. All services are provided by licensed, insured contractors.

Our website is informational. Submitting a contact form or requesting an estimate does not create a service contract. A binding agreement is only established when both parties sign a written service contract.

3. Estimates and Pricing

All estimates we provide are based on the information available at the time of the site visit. Estimates are not guarantees of final cost. Final pricing may change if the scope of work changes, if unforeseen site conditions are discovered once work begins, or if material costs change between the estimate date and the start of work.

We will notify you in writing of any material cost changes before proceeding. Additional work outside the original written scope requires a signed change order before it begins.

All estimates are valid for 30 days from the date they are issued unless otherwise stated in writing.

4. Scheduling and Cancellation

Scheduling of work is subject to contractor availability, permit approval timelines, and weather conditions. We will provide you with an estimated start date once permits are approved and materials are secured, but start dates are not guaranteed to the day.

If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations made after a deposit is paid and permits have been submitted may result in forfeiture of permit fees and any non-recoverable material costs incurred on your behalf.

We reserve the right to reschedule work due to weather, crew availability, permit delays, or other circumstances outside our control. We will notify you promptly of any scheduling changes.

5. Payment Terms

Payment terms are specified in your written service contract. In general, we require a deposit prior to permit submission, a progress payment at an agreed milestone during construction, and a final payment upon completion and your acceptance of the finished work.

Final payment is due upon substantial completion of the project. Withholding final payment for reasons unrelated to agreed-upon scope or documented defects is not permitted.

Overdue balances may be subject to interest at the maximum rate permitted byCalifornia law. We reserve the right to pursue collection of unpaid balances through appropriate legal channels.

6. Permits and Inspections

We are responsible for obtaining required building permits on your behalf as part of the agreed scope of work. Permit fees are passed through to you at cost and are itemized in your contract.

We will schedule all required inspections with the appropriate local authority. You are responsible for ensuring site access for inspectors during agreed inspection windows. Delays caused by denied access or failed inspections due to conditions outside our control may affect project timelines.

7. Warranty Disclaimers

We warrant our workmanship against defects for one year from the date of substantial completion, unless a different warranty period is specified in your written contract. This warranty covers defects in our installation and construction work. It does not cover damage caused by misuse, alterations made by others, acts of nature, or normal wear and tear.

Manufacturer warranties on materials, windows, frames, and other products are separate from our workmanship warranty and are governed by the terms of each manufacturer. We will assist you in submitting a manufacturer warranty claim where applicable.

Except as expressly stated above, all services are provided "as is" and we disclaim all other warranties, express or implied, to the fullest extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Lompoc Sunrooms and Patios will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from a specific project will not exceed the total amount paid by you for that project. This limitation applies to all causes of action, whether based on contract, tort, or any other legal theory.

9. Dispute Resolution

We encourage you to contact us directly first if you have a concern or complaint. We are committed to resolving issues promptly and fairly. You can reach us at the contact information in Section 11 below.

If a dispute cannot be resolved informally, both parties agree to first attempt resolution through non-binding mediation before initiating any legal proceeding. The mediator will be mutually agreed upon by both parties.

Any unresolved disputes will be submitted to binding arbitration in Santa Barbara County, California, under the rules of a recognized arbitration organization. The arbitrator has the authority to award any remedy available under applicable law.

10. Governing Law

These terms and conditions, and any disputes arising out of or related to our services or website, are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration will be brought in a court of competent jurisdiction in Santa Barbara County, California.

11. Policy Modifications

We reserve the right to update these terms at any time. Changes take effect when posted to this page. The effective date at the top of this page will reflect when the most recent update was made.
